Differentiation Claim and Substantiation Record

A product difference matters when a defined buyer can perceive it, values it against a real alternative, believes the support, and receives it consistently at acceptable economics.

The test begins with a comparison. Name the target customer, job, current alternative, proposed difference, proof, expected tradeoff, and price consequence. Then test recognition before explanation. If a buyer cannot notice the difference, the product or presentation may need work. If the buyer notices but does not value it, the positioning may be decorative rather than decision-relevant.

Objective claims need evidence before public use. The FTC advertising substantiation policy describes a reasonable-basis requirement for express and implied objective claims. The Green Guides summary warns against broad, unqualified environmental-benefit claims and calls for clear, specific qualifications and substantiation.

Identity is part of differentiation but not a substitute for it. The USPTO federal-search guidance explains that confusing similarity can concern appearance, sound, meaning, commercial impression, and related goods or services. A federal search is not a complete clearance opinion.

The decision output is strengthen, test, reposition, or reject. It is not a claim that customer interviews or a small experiment prove future demand.
